SleepPublish Terms of Service

1. Acceptance of Terms
By downloading, installing, or using SleepPublish ("the App," "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Mactrix ("we," "us," or "our").
2. Description of Service
SleepPublish is an AI-powered content automation service that:
- Generates a 30-day content plan based on your niche and strategy
- Automatically writes SEO-optimised articles using artificial intelligence
- Publishes those articles directly to your connected website or blog CMS
- Operates on a scheduled basis without requiring manual intervention
3. Eligibility
You must be at least 18 years old to use SleepPublish. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into this agreement.
4. Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must provide accurate and complete information when creating your account
- You must notify us immediately if you suspect unauthorised access to your account
- We reserve the right to suspend or terminate accounts that violate these Terms
5. Subscriptions and Payments
### Free Credits
New accounts receive a limited number of free article generations ("Free Credits") to try the Service. Once Free Credits are exhausted, a Pro subscription is required to continue generating articles.
### Pro Subscription
- Pro subscription is offered as a monthly or annual auto-renewing subscription
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You can manage and cancel your subscription through your Apple ID Account Settings
- No refunds are provided for partial subscription periods, except where required by law
### Price Changes
We reserve the right to change subscription prices. We will provide reasonable notice of any price changes before they take effect.
6. Acceptable Use
You agree NOT to use SleepPublish to:
- Publish content that is illegal, defamatory, harassing, threatening, or fraudulent
- Generate or publish content that infringes on any third party's intellectual property rights
- Publish spam, misleading content, or content designed to manipulate search engines in violation of their terms
- Attempt to reverse-engineer, hack, or disrupt the Service
- Use the Service for any purpose other than publishing legitimate content to your own website or blog
- Share your account credentials with others or resell access to the Service
7. AI-Generated Content
### Your Responsibility
SleepPublish uses artificial intelligence to generate articles on your behalf. You are solely responsible for all content published to your website through the Service. You should:
- Review AI-generated content before it is published where possible
- Ensure published content complies with the laws of your jurisdiction
- Ensure published content complies with your CMS platform's terms of service
- Ensure you have the right to publish in the niche and on the topics generated
### No Guarantee of Accuracy
AI-generated content may occasionally contain inaccuracies, outdated information, or errors. We make no warranty that generated content is accurate, complete, or fit for any particular purpose. You are responsible for fact-checking content before it reaches your audience.
### No Guarantee of SEO Results
While SleepPublish is designed to produce SEO-optimised content, we make no guarantee or representation that using the Service will result in improved search engine rankings, increased traffic, or any specific business outcome. SEO results depend on many factors outside our control.
8. CMS Credentials and Third-Party Platforms
By providing your CMS credentials (API keys, tokens, passwords) to SleepPublish:
- You confirm that you are authorised to connect that CMS account
- You grant us permission to publish content to that CMS on your behalf
- You remain solely responsible for your relationship with your CMS provider
- We are not responsible for any changes your CMS provider makes to their API, pricing, or terms
9. Intellectual Property
### Your Content
You retain full ownership of all articles generated and published through SleepPublish. The content strategy, writing samples, and published articles belong to you.
### Our Service
The SleepPublish app, its design, code, branding, and underlying technology are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE
- ARTICLES WILL BE PUBLISHED AT EXACTLY THE SCHEDULED TIME
- THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS
- AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
- Your use of the Service
- Content published through your account
- Your violation of these Terms
- Your violation of any third party's rights
13. Termination
### By You
You may stop using the Service and delete your account at any time through Settings → Danger Zone → Delete My Account.
### By Us
We reserve the right to suspend or terminate your account at our discretion if:
- You violate these Terms
- We reasonably believe your use of the Service is harmful or fraudulent
- We are required to do so by law
Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.
14. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of the United States.
